A provider-patient relationship is established only after the completion and submission of all required intake documentation, review and acceptance by a qualified provider, and mutual agreement to proceed with care. Nothing on this website or in any communication should be interpreted as a substitute for professional medical advice, diagnosis, or treatment. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.
2. Telehealth Services
Telehealth services provided by Pink Pony Wellness are subject to provider licensure requirements, applicable federal and state regulations, and location verification protocols. You must be physically located in an authorized state at the time of your telehealth visit. Telehealth has inherent limitations, including but not limited to the inability to perform physical examinations, potential technology disruptions, and limitations in diagnosing certain conditions. By using our telehealth services, you acknowledge and accept these limitations.
3. Eligibility
You must be at least 18 years of age and legally capable of entering into binding agreements to use our services. By accessing or using Pink Pony Wellness services, you represent and warrant that all information you provide is accurate, complete, and current. You agree to update your information promptly if any changes occur.
4. No Guarantee of Results
Individual outcomes vary and are influenced by numerous factors including genetics, lifestyle, adherence to treatment plans, and overall health status. Pink Pony Wellness makes no guarantees regarding the results of any services, including but not limited to weight loss programs, hormone optimization therapy, aesthetic treatments, sexual health therapies, or any other services offered. All treatment plans are individualized and tailored to each patient’s unique needs and circumstances.
5. Payment Terms
Pink Pony Wellness operates on a cash-pay basis. We do not bill insurance and are not contracted with any insurance providers. Payment is due at the time of booking or at the time services are rendered, depending on the service type. All fees are subject to change at any time without prior notice. It is your responsibility to review current pricing before scheduling services.
6. Intellectual Property
All website content, branding, logos, text, graphics, images, and design elements are the exclusive property of Pink Pony Wellness and are protected by applicable intellectual property laws. No content may be copied, reproduced, distributed, modified, or used in any manner without the prior written consent of Pink Pony Wellness.
7. SMS/Text Messaging Consent
By providing your phone number to Pink Pony Wellness, you consent to receive text messages for appointment reminders, scheduling communications, care coordination, and general communications related to your care. You may opt out of text messaging at any time by replying STOP to any message. Please note that text messaging is not intended for emergency communications. Standard message and data rates may apply depending on your carrier and plan. SMS communications may not be fully secure, and you acknowledge this risk by opting in.
8. Limitation of Liability
To the fullest extent permitted by law, Pink Pony Wellness shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, telehealth services, treatment outcomes, or any delays in care. In no event shall the total liability of Pink Pony Wellness exceed the amount you have paid for the services giving rise to the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Pink Pony Wellness, its owners, providers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of or related to your misuse of our services, violation of these Terms & Conditions, provision of inaccurate information, or failure to follow medical advice provided by your care team.
10. Binding Arbitration & Multi-State Venue
Any disputes arising out of or relating to these Terms & Conditions or your use of Pink Pony Wellness services shall be resolved through binding arbitration. Arbitration shall take place in the state where services were rendered, the principal place of business of Pink Pony Wellness, or a mutually agreed-upon location. By agreeing to these terms, you waive your right to a jury trial.
11. Class Action Waiver
All disputes must be brought in your individual capacity and not as a plaintiff or class member in any purported class, consolidated, or collective action. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
12. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the state in which services are rendered, without regard to conflict of law principles.
13. Severability
If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall not be affected or impaired.
14. Modifications
Pink Pony Wellness reserves the right to update, modify, or revise these Terms & Conditions at any time without prior notice. Any changes will be effective immediately upon posting to our website. Your continued use of our services following any modifications constitutes your acceptance of the updated terms.
